Notice of Privacy Rights of California Residents


This Privacy Policy is designed to advise you about how we collect, use, and protect the personal information we may collect from you. Telsolv, LLC, and its affiliates (collectively, “TELSOLV”, “we,” “us,” or “our”) believe that respecting your privacy is important. We have found that collecting Personally Identifiable Information (defined below) and Non-Personally Identifiable Information (defined below) through our website, www.TELSOLV.com, and our other online locations such as TELSOLV’s social platforms (collectively, the “Sites”) helps us serve you better by enabling us to communicate with you, receive and deliver your order, and understand the pages, products and services that are interesting and helpful to you. This Privacy Policy describes the types of information we gather online and offline and how that information is used. Please read this Privacy Policy carefully.

1. How does this Privacy Policy apply to me?

Each time you access, use or browse any of the Sites or otherwise interact with TELSOLV, you agree to be bound by this Privacy Policy. TELSOLV reserves the right to change this Privacy Policy at any time. If you do not accept this Privacy Policy, please do not access, use or browse the Sites, or otherwise interact with TELSOLV.

Should the Privacy Policy be revised, TELSOLV will post the changes on a Site and the new Privacy Policy will be effective immediately upon posting. Any material changes in the way that we use Personally Identifiable Information will apply only to information collected thereafter, unless we provide notice or have other communications with you. You can determine when the Privacy Policy was last revised by referring to the “Last Revised” legend at the top of this page. Each time you access, use or browse the Sites, you signify your acceptance of the then-current Privacy Policy.

The Privacy Policy and the Terms of Use form an agreement that is effective as if you had signed it. Any capitalized term not defined in this Privacy Policy has the meaning set forth in the Terms of Use.

2. What types of information are collected?

The Sites may collect two types of information about users: Personally Identifiable Information and Non-Personally Identifiable Information.

“Personally Identifiable Information” includes, without limitation, non-public information about you that helps TELSOLV identify you, such as first and last name, email address, street address, telephone number, credit or debit card number or other payment method, billing and shipping information, order history, and financial information.

“Non-Personally Identifiable Information” includes, without limitation, information that does not personally identify you as the individual to whom the information relates, such as information that is aggregated by TELSOLV or a third party, or information that is not linked to contact information or other Personally Identifiable Information about you, such as your Internet Protocol (“IP”) address, browser type, operating system, general geographic location, domain name of your internet service provider, cookies and other Collection Technology information (described below), general information about the frequency of Site visits, pages requested, number of users, activities while visiting the Site, content accessed, and the like.

In addition, TELSOLV may collect information about you, such as your password, device, mobile carrier, preferences and interests, demographic information, precise geographic location, shopping habits, Site usage, age and gender. In the event that such information is maintained with your name or contact information, it will be treated as Personally Identifiable Information; otherwise, such information will treated as Non-Personally Identifiable Information.

3. How do you collect Personally Identifiable Information?

General: Personally Identifiable Information is collected online by us or our service providers on our behalf when users communicate with us about orders or other questions. We also may collect information about your transactions and interactions with us and our vendors, including information about your use of products and services offered by TELSOLV. We may collect information about you from other sources, such as blogs, public resources, third parties and other users of the Sites and our Services. In addition, Personally Identifiable Information may be collected offline and through social media, as described below.

Offline: When you purchase products or services from TELSOLV, or sign up to receive promotional materials about products or services from TELSOLV, your Personally Identifiable Information will be collected and treated in accordance with this Privacy Policy.

Social Media: Certain information you post or provide through parts of the Sites that are available to others, such as your name, profile, comments, collections and reviews, may be shared with other users and posted on publicly available portions of sites. Please keep in mind that if you choose to disclose Personally Identifiable Information when posting comments or other information or content through the Sites, this information may become publicly available and may be collected and used by others, including people outside the TELSOLV community. It is up to you to make sure you are comfortable with the information you choose to provide TELSOLV and the information you choose to include in your submissions. Your submissions may be available to Site users and to users of other websites and services; TELSOLV will not have any obligations with respect to any information that you include in your submissions. We recommend that you use caution when giving out Personally Identifiable Information to others through social media networks or otherwise, as such information may be or become publicly available. You can protect Personally Identifiable Information by not including identifying information in your submissions.

You may choose to access the Sites using the Facebook Connect feature. By doing this, you are asking Facebook to send us certain information from your Facebook profile, and you authorize us

to collect, store and use in accordance with this Privacy Policy any and all information available to us through the Facebook interface.

4. How do we collect Non-Personally Identifiable Information?

General: Non-Personally Identifiable Information is collected automatically on our server logs from your browser, as well as through other analysis of the Sites. Non-Personally Identifiable Information is also collected through cookies, other Collection Technology, IP Addresses and Google Analytics, as well as from third parties and feedback TELSOLV receives, as described below.

Cookies: A cookie is a piece of data stored on your computer, which is a standard feature of browser software. A cookie assigns each visitor a unique, random number that resides on your computer. The cookie does not actually identify the visitor, just the computer that a visitor uses to access the Site. If you view a Site, your web browser may store cookies on your computer, which will better enable you to navigate the Site when you return. We use cookies to help deliver a more personalized experience. For example, cookies allow us to track the pages on the Site that you visit and how often you visit. When you visit our site, a cookie may be dropped on your computer or device, and such cookie may be used to deliver targeted content or advertisements to you as described below. Our cookies do not include Personally Identifiable Information or sensitive information such as your credit or debit card number. Cookies also may be used by some of the websites to which we link. We do not control the use or contents of third party cookies.

You can set your browser not to accept cookies. You may use the Sites even if you choose to reject or delete the cookies. However, if you do, you may not be able to take full advantage of the features of the Sites. To enable or disable cookies on your browser, please consult your browser documentation or contact your software provider.

Pixel Tags/Clear GIFs/Web Beacons: A pixel tag, also known as a clear GIF or web beacon, is an invisible tag that may be placed on certain pages of the Site but not on your computer (“Collection Technology”). When you access these pages, pixel tags generate a generic notice of that visit. They usually work in conjunction with cookies, registering when a particular computer visits a particular page. If you turn off cookies the pixel tag will simply detect an anonymous website visit.

IP Address: We may use your IP address to analyze trends, administer the Sites and gather broad demographic information for aggregate use to improve the Sites; in doing so, we will not link your IP address to your Personally Identifiable Information.

Google Analytics: The Sites use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies and other Collection Technology to collect and store anonymous information about you, which may include Non-Personally Identifiable Information. The Sites use “Demographics and Interest Reporting” feature of Google Analytics based on Display Advertising to analyze information regarding the interests and demographics of users of the Sites.

You can opt-out from being tracked by Google Analytics in the future by downloading and installing Google Analytics Opt-out Browser Add-on for your current web browser at http://tools.google.com/dlpage/gaoptout?hl=en.

Third Parties: TELSOLV also may acquire Non-Personally Identifiable Information from other sources (such as offline records or publicly available information) and from vendors and other third parties, some of which partner with TELSOLV. Non-Personally Identifiable Information also may be obtained by these other sources from inferences based upon the sites you visit, third party data, information you share on other websites, social media platforms and applications, or demographics derived from profiles or accounts that you create, to the extent permitted in their privacy policies.

Feedback Information: If you provide feedback to TELSOLV, TELSOLV may use and disclose such feedback for any purpose, provided TELSOLV does not associate such feedback with your Personally Identifiable Information. TELSOLV will collect any information contained in such feedback and will treat the Personally Identifiable Information in it in accordance with this Privacy Policy. You agree that any such comments and any e-mail we receive becomes our property. TELSOLV may use feedback for marketing purposes or to add to or modify Services without paying any royalties or other compensation to you.

5. Are children allowed to use the Sites?

You must be over the age of 18 years or older to use our Sites. The Sites and TELSOLV’s products and services are not directed toward children under the age of 13. TELSOLV and the Sites do not knowingly collect Personally Identifiable Information from children under age 13. If you are under age 13, you are not permitted to use the Sites or to submit any Personally Identifiable Information to the Sites. If you are between 13 and 17 years of age, please ensure that you use the Sites only with the permission of a parent or guardian. If we become aware that a Site user is under age 18 and has provided Personally Identifiable Information, we will take steps to remove his or her Personally Identifiable Information from our files. 6. How may we use and disclose Personally Identifiable Information?

General: TELSOLV and its affiliates may use your Personally Identifiable Information to process and fulfill orders, ship and confirm orders, administer and process payments, provide customer service, update account and profile information, administer activities, improve your Site experience and TELSOLV’s products and services, forward promotional emails and postal mail, forward updates and announcements, and communicate with you about the Site, activities, communication services, and the products and services of TELSOLV and its affiliates. TELSOLV also may use Personally Identifiable Information to send you information about third parties who may have products or services of interest to you.

TELSOLV may combine Personally Identifiable Information collected through the Sites with information available from other sources (such as offline records or publicly available information). We will treat the combined information as Personally Identifiable Information.

Requested and Promotional Email: You authorize TELSOLV to transmit email to you to respond to your questions or address your orders, billing or use of communications services. Unsubscribe instructions are included in each promotional email.

Service Providers and Other Third Parties: TELSOLV may disclose Personally Identifiable Information to third parties that we may hire to perform services on our behalf. In addition, we work closely with affiliated businesses, including those with co-branded and joint offerings, and we may share Personally Identifiable Information and Non-Personally Identifiable Information related to such offerings with such affiliated businesses. We may share Personally Identifiable Information and Non-Personally Identifiable Information with our service providers, shippers, vendors, advertisers, consultants, and affiliates for our internal business purposes, Site analysis or administration, communications with users, order payment and fulfillment, order delivery, marketing or similar activities. TELSOLV also may share your Personally Identifiable Information with third parties for their direct marketing purposes.

TELSOLV may provide some of our product and service offerings through contractual arrangements made with affiliates, service providers, partners and other third parties (“Service Partners”). We and our Service Partners may use your Personally Identifiable Information and Non-Personally Identifiable Information in order to perform tasks between our respective sites, or to deliver products or services to you. The use of your Personally Identifiable Information and Non-Personally Identifiable Information by our Service Partners is governed the respective privacy policies of those providers, and is not subject to our control. Other sites accessible through the Sites, including our Service Partners, have their own privacy policies and data collection, use and disclosure practices. Please consult each site’s privacy policy. We are not responsible for the policies or practices of third parties.

Legal and Safety Reasons: TELSOLV may disclose Personally Identifiable Information as required by applicable law or as necessary or advisable to: (a) protect TELSOLV’ rights, safety or property or the rights, safety or property of others; (b) enforce the Terms of Use; (c) respond to your orders or requests for customer service or other information; (d) comply with legal process or cooperate with law enforcement or governmental requests; (e) investigate, prevent or take action regarding suspected illegal activities, fraud or potential threats, or exercise legal rights or defend against claims; or (f) comply with or as permitted by applicable laws and regulations.

Major Transaction: TELSOLV reserves the right to transfer any and all information, including without limitation Personally Identifiable Information, collected from Site users to an affiliate or third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or disposition of all or any portion of our business or operations (including without limitation in connection with bankruptcy or any similar proceedings).

7. How may we use and disclose of Non-Personally Identifiable Information?

General: The use and disclosure of Non-Personally Identifiable information is not subject to any restrictions under this Privacy Policy. TELSOLV may use Non-Personally Identifiable Information to improve the Sites, enable Site features and enhance our services. For example, TELSOLV may analyze how our Sites are used to improve the browsing experience for the Sites, analyze the performance of the Sites and diagnose problems, administer the Sites, and carry out internal operations.

Additionally, we may take personally identifiable information and de-identify it and share it in a de-identified or aggregated form with third parties to show or analyze site usage, improve our services, improve our user experience, or for similar purposes.

Advertising: TELSOLV also may use your Non-Personally Identifiable Information to present you with targeted content and advertisements (including on third party websites and apps) based on your past visits to the Sites and your Non-Personally Identifiable Information collected over time by us and third parties. Such targeted content and advertisements may include marketing for the Sites, Products, Services or the sites, products and services of TELSOLV' business and advertising partners. Your Non-Personally Identifiable Information also may be used to analyze and develop advertisements and advertising campaigns, provide you with special offers and promotions and determine the effectiveness of same, optimize and determine the effectiveness of content and advertisements, analyze your interactions with the content and advertisements you are presented with, and how same relates to your visits to the Sites. TELSOLV does not share any of your Personally Identifiable Information with our remarketing ad networks or advertisers.

Opt Out: Some of our third party partners may participate in the Digital Advertising Alliance’s Self-Regulatory Program for Online Behavioral Advertising and allow consumers the ability to opt-out of targeted advertising based on web activity tracking. Please note that even if our third party partners participate in the Digital Advertising Alliance’s Self-Regulatory Program for Online Behavioral Advertising and you opt of targeted advertising based on web activity tracking, you still may receive standard advertisements from us and targeted advertisements from third parties after clicking the link and following the instructions provided therein. You may need to re-click the link and follow the instructions provided therein if you delete cookies or other Collection Technology or use a different computer, device or browser.

Do Not Track: Except as otherwise specified in this Privacy Policy, TELSOLV does not alter the practices detailed herein based upon your selection of the “Do Not Track” setting or other “opt out” setting or feature that may be offered by your browser; however, TELSOLV reserves the right to do so in the future.

8. How can you Opt-Out?

You are responsible for keeping your Personally Identifiable Information current. You may update your Personally Identifiable Information by sending an email to sales@TELSOLV.com. You may not opt out of receiving communications regarding your purchases, your dealings with the Sites, or technical information about the Sites.

If you prefer not to receive marketing or promotional emails from TELSOLV, you may click on the “Unsubscribe” link in any promotional email you receive from us and follow the “Unsubscribe” instructions. Please note that such requests may take up to ten (10) days to become effective.

9. California Residents: How may you exercise your rights under the CCPA?

If you are a resident of California, you may have certain rights under the California Consumer Privacy Act (“CCPA”).

Categories of personal information we collect. The personal information that we may collect fall into the following categories established by the CCPA, depending on the services you use:

A. Identifiers such as your name, phone number, and address, as well as unique identifiers tied to the browser, application, IP address, or device you’re using;

B. personal information, such as a credit card number;

C. Demographic information, such as your age, gender and language;

D. Commercial information such as your payment information and a history of purchases you make using our services;

E. Internet, network, and other activity information such as your search terms, views and interactions with content and ads, and activity on third-party sites and apps that use our services;

F. Geolocation data, such as may be determined by GPS, IP address, and other data from sensors on or around your device; and

G. Inferences drawn from the above, such as information about your purchase preferences.

Business purposes for which information may be used or disclosed. The personal information that we may disclose about consumers for a business purpose fall into the following purposes established by the CCPA, depending on which services you use:

A. Protecting against security threats, abuse, and illegal activity;

B. Auditing and measurement, such as for analytics and measurement to understand how our services are used, as well as to fulfill obligations to our service partners;

C. Maintaining our services, such as to ensure our services are working as intended, including tracking outages or troubleshooting bugs and other issues that you report to us;

D. Research and development, such as to improve our services and to develop new products, features and technologies that benefit our users and the public

E. Use of service providers to perform services on our behalf, in compliance with our Privacy Policy and other appropriate confidentiality and security measures;

F. Advertising, including online identifiers and information about your interactions with advertisements; and

G. Legal reasons, such as to satisfy applicable laws or regulations, and discloses information in response to legal process or enforceable government requests, including to law enforcement.

Right to access or delete personal information: The CCPA gives you the right to request information about how we collect, use, and disclose your personal information. And it gives you the right to access your information and request that we delete that information. To make such a request, send an email to sales@TELSOLV.com, specifying that you seek your “California Customer Choice Privacy Notice.” Please allow thirty (30) days for a response. TELSOLV is required to respond to only one request per customer each year, and is not required to respond to requests made by means other than through the above email address.

Do not sell my personal information. The CCPA defines the “sale” of information broadly. While we generally do not directly sell your personal information in the conventional sense (i.e., for money), like many companies we may use services that help deliver interest-based ads to you and may transfer personal information to business partners for their use. Making personal information available to these companies may be considered a “sale” under the sales@TELSOLV.com or mail your request to:

Please note that there is no charge for controlling the sharing of your Personally Identifiable Information or for processing this request.

No discrimination. We will not discriminate against you for exercising your rights under the CCPA.

10. How do we protect Personally Identifiable Information?

TELSOLV uses reasonable administrative, physical and electronic security measures to protect against the loss, misuse and alteration of your Personally Identifiable Information.

No transmission of data over the internet is guaranteed to be completely secure. It may be possible for third parties not under the control of TELSOLV to intercept or access transmissions or private communications unlawfully. While we strive to protect your Personally Identifiable Information, neither TELSOLV nor our service providers can ensure or warrant the security of any information you transmit to us over the internet. Any such transmission is done at your own risk.

11. What about third party posts and links to other websites?

The Site may include posts by or links to websites operated by third parties. TELSOLV endeavors to allow posts or links to reputable organizations; however, because third parties and other sites are not hosted or controlled by us, TELSOLV is not responsible for the privacy practices of those sites or third parties, or their content or activities. We encourage you to review the privacy policies

of third parties and their websites. This Privacy Policy only applies to information that TELSOLV collects through the Sites and does not address the privacy or information practices of any third parties or other websites.

12. Governing Law

This Privacy Policy shall be governed by, and will be construed under, the laws of the State of Georgia, U.S.A., without regard to choice of law principles. Those who choose to access the Sites from locations outside the United States do so on their own initiative, and are responsible for compliance with local laws if and to the extent local laws are applicable. TELSOLV may limit the Sites’ availability, in whole or in part, concerning any person, geographic area or jurisdiction, at any time in its sole discretion. TELSOLV may host or store servers and information within or outside the United States.
